These Terms of Service ("Terms") govern your use of bndtgthr.com and the BND TGTHR service (the "Service"), operated by Bnd Tgthr, Inc. ("BND TGTHR," "we," "us," or "our"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What BND TGTHR is

BND TGTHR is a crowd-funding platform for live shows. Fans pick an artist, a venue, and a date, and buy a ticket to start or join a campaign. A show happens only if the campaign reaches its goal before its deadline. We are a platform that connects fans, artists, and venues — we are not the performer or the venue operator, and we don't produce the shows.

2. Eligibility and accounts

You must be able to form a legally binding contract (generally at least 18 years old) to buy tickets or list as an artist or venue. We use passwordless "magic link" sign-in tied to your email; keep access to your email secure. You're responsible for activity that happens through your account.

3. How campaigns work

  • A campaign runs for a fixed window of 7 days from the time it's created. The scheduled show date is always at least 14 days out — at least 7 days after the deadline.
  • A campaign succeeds only if all of its tickets sell before the deadline. When it succeeds, the show is confirmed.
  • If the campaign does not sell out by the deadline, it fails and the show does not happen.

4. Prices, fees, and payment

  • Prices are in U.S. dollars. When you buy a ticket, you are charged the ticket price plus a service fee equal to 20% of the ticket price, shown to you as a single total at checkout.
  • Payment is collected through Stripe at the time of purchase, not when the campaign ends.

5. Refunds

  • If a campaign succeeds, your purchase is final and your ticket is issued. Except where required by law, purchases on a successful campaign are non-refundable — including if you change your mind or can't attend.
  • If a campaign fails (doesn't sell out by the deadline), we automatically refund the ticket price in full to your original payment method. You don't need to request it.
  • The 20% service fee is non-refundable, including when a campaign fails. It pays for running the platform and processing your payment.
  • Refunds are issued through Stripe and may take several business days to appear, depending on your bank or card issuer.

6. Tickets and admission

Tickets are issued as QR codes tied to your account and are valid for a single admission. Don't copy, resell, or share your ticket. Admission is subject to the rules of the venue and the performing artist, and to any age or capacity restrictions.

7. Artists and venues

  • If you list as an artist or venue, you're responsible for the accuracy of your listing (availability, pricing, capacity, location, and media) and for honoring confirmed shows.
  • Payouts for successful shows are made through Stripe Connect to the payout account you connect. You're responsible for the tax and legal obligations that apply to money you receive.
  • We may decline, edit, or remove any listing, campaign, or content, and we may suspend accounts that violate these Terms.

8. Acceptable use

Don't use the Service to commit fraud, to scalp or resell tickets, to use bots or automated buying, to interfere with the Service, or to break the law or the rights of others.

9. Cancellations and changes

A confirmed show may still be changed or canceled by the artist or venue, or by events beyond our control. If a confirmed show is canceled, we will refund the ticket price for affected tickets; the service fee remains non-refundable. We are not responsible for travel, lodging, or other costs you incur.

10. Our role as organizer

  • BND TGTHR acts solely as the organizer of shows arranged through the Service. We are not a party to any agreement between an artist and a venue, and we are not responsible or liable for any act or omission of an artist or a venue — including either side's performance or breach of their agreement.
  • You agree not to name or join BND TGTHR, Bnd Tgthr, Inc., or their employees, shareholders, officers, or affiliates as a party in any civil action or suit arising out of, in connection with, or related to any act or omission of an artist or a venue.
  • If a dispute arises between an artist and a venue over funds we hold, we may either hold the funds until the dispute is resolved by a written agreement signed by both parties or by an order of a court of competent jurisdiction, or deposit the funds with such a court pending resolution. Once the funds are delivered accordingly, our obligations with respect to them end.

11. Force majeure

If a show is prevented, or rendered impossible or infeasible, by something beyond the parties' control — including artist illness or serious injury, an act of God, severe weather, any act or regulation of a public authority, civil unrest, strike, epidemic, interruption or delay of transportation, war conditions, or other emergency — no party will have a claim for damages against any other, the parties' obligations for that show are waived, and money paid in connection with the show is refunded to its source as described in Sections 5 and 9.

12. Venue safety, insurance, and indemnification

  • Venues agree to take reasonable security measures to ensure the safety of artists and fans at their events.
  • Venues agree to carry valid, current commercial general liability insurance covering each event they host, from the date of the event through completion of the artist's load-out.
  • Venues agree to indemnify and hold artists — as well as their agents, representatives, employees, and contractors — harmless from and against any loss, damage, or expense arising from injury, theft, or property damage caused by the venue's negligence, or from the venue's breach of these Terms.

13. Attending shows

Shows are put on by artists and venues, who are responsible for what happens at their events to the extent it's their fault. It's still up to you to take reasonable care of yourself and the people around you at a show. BND TGTHR is not liable for injury, loss, or theft at an event.

14. Disclaimers

The Service is provided "as is" and "as available." We don't guarantee that any campaign will succeed, that any show will occur, or that the Service will be uninterrupted or error-free. We act as an intermediary between fans, artists, and venues.

15. Limitation of liability

To the fullest extent permitted by law, BND TGTHR and Bnd Tgthr, Inc. will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the Service will not exceed the amount you paid to us in connection with the transaction giving rise to the claim.

16. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date above, and continued use of the Service means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Los Angeles County, California.
